The license is still applied, but you are technically violating the contrbutor's copyright by distributing it. So it's generally a good idea to say what the license is and provide a copy.

Do you think the apache 2.0 license suits MCServer? I can still change it on googlecodeTongue (though I'm not sure that's legal)

It seems a nice license, and it would be a huge hassle to change it - getting everybody that has ever contributed to relicense their contributions (if you wanted the whole project to have one license).

I personally prefer the MIT and BSD licenses but I don't really mind as long as it's sensible.
