I've been reading up on this a lot. There's a lot of gray area involved that only lawyers/judge can really draw a definitive line on. Try not to get bogged down by the discussions as it's mostly just bias banter.
To me there are at least a few things that are certain:
1. Mojang isn't going to open source their server software
2. The whole situation is bad for the Minecraft community
3. There's going to be a solution weather it's CraftBukkit revived or not
One positive way to spin it though, it might bring more people to get involved in alternative projects like this one.
I wouldn't have been looking for one myself if it weren't for all that, and that's how I stumbled my way in here.
